Chapter 13 Bankruptcy
Chapter 13 Bankruptcy allows individuals to adjust outstanding debt. Unlike Chapter 7, where non-exempt assets will be gathered and sold, Chapter 13 allows assets to be retained by the debtor, subject to the approval of a three to five year repayment plan. Chapter 13 protection is also sought by individuals who do not qualify for Chapter 7 bankruptcy. Under Chapter 13 protection, there is no discharge of debt until the repayment plan is complete, but while the plan is in effect, the debtor is protected from any further actions by creditors. This includes preventing creditors from foreclosing on your home and your car from being repossessed.
